These terms and conditions (“Terms”) govern your access to and use of https://bhowra.com (“Website”) and the Bhowra HRMS platform and services (the “Services”, and together with the Website, the “Platform”). These Terms also incorporate our Privacy Policy and any guidelines or additional terms we publish from time to time.
These Terms form a binding legal contract between Bhowra Technologies Private Limited (“Bhowra”, “we”, “us”) and you (a “User”). You represent that you (a) have the legal capacity and authority to agree to these Terms, and (b) are at least eighteen (18) years of age. If you accept these Terms on behalf of an organisation, you confirm you are authorised to bind that organisation. By using the Services you agree you have read, understood and are bound by these Terms. If you do not agree, do not use the Platform.
The Services are currently offered in a private alpha (pre-release) state on an invite-only basis. They are provided “as is” and “as available”, are still under active development, may contain defects, and may change, be interrupted, or be discontinued at any time. You should not rely on the alpha Services as the sole system of record for business-critical functions (for example, statutory payroll filings) without independent verification.
Bhowra is a cloud-based, metadata-driven Human Resource Management System (HRMS) that helps organisations manage the employee lifecycle — including employee records, recruitment, onboarding, attendance, leave, payroll, performance and statutory compliance. The provision of the Platform and its features collectively constitutes the “Services”.
To use the Services you may be required to create a profile (“Profile”) and provide certain details. You warrant that all information you provide is accurate and kept up to date. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your Profile, and you agree to notify us immediately of any unauthorised use. Bhowra is not liable for any loss arising from unauthorised access to your Profile caused by your failure to safeguard your credentials.
You agree to receive service communications relating to the Services. With your consent, we may also send product updates and offers; you can opt out of marketing communications at any time by emailing support@bhowra.com.
The Services may include or link to services, content or information provided by third parties (“Third Party Services”). Such Third Party Services are the responsibility of the relevant third party, and your use of them is at your own risk. We make no warranties regarding Third Party Services, and all intellectual property in them belongs to the respective third parties.
You warrant that all information you provide is complete, true and correct, and you undertake to notify us promptly of any change. You are solely responsible for your compliance with applicable laws. You must not:
All rights, title and interest in the Platform and Services, including all intellectual property, are owned by or licensed to Bhowra. Subject to these Terms, Bhowra grants you a non-exclusive, non-transferable, non-sub-licensable, revocable and limited licence to use the Platform in accordance with these Terms. If you submit suggestions or feedback (“Feedback”), Bhowra may freely use it without restriction or obligation to you.
These Terms remain in effect until terminated. Bhowra may suspend or terminate your access to the Services at any time if you breach these Terms. On termination, your right to use the Services ends, and any clauses intended to survive (including limitation of liability, indemnity and governing law) will continue. Any amounts due remain payable.
Your use of the Services is at your sole risk. To the extent permitted by law, the Services are provided on an “as is” and “as available” basis. Bhowra does not warrant that the Services will be uninterrupted, error-free, or that they will meet your requirements, and disclaims all implied warranties including merchantability, fitness for a particular purpose, accuracy, title and non-infringement.
To the maximum extent permitted by law, Bhowra and its affiliates will not be liable for any indirect, incidental, special or consequential damages, or any loss of revenue or profits, arising out of or relating to these Terms or the Services. This includes loss arising from your use of (or inability to use) the Services, any defect or interruption, or any unauthorised access to our systems.
You agree to indemnify and hold harmless Bhowra, its affiliates and their officers, employees and agents from any claim, loss, liability or cost (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or any infringement by a third party using your account.
You agree that Bhowra may collect and use your information in accordance with our Privacy Policy, and may use aggregated and anonymised usage data to improve the Platform. Where required by law, Bhowra may disclose data to law enforcement or governmental authorities.
Bhowra may modify these Terms or the Services from time to time. We will communicate material changes via the Website and, where applicable, by email; continued use of the Services after changes take effect constitutes acceptance. The current version is always available on the Platform.
These Terms are governed by the laws of India. Subject to the arbitration provision below, the courts at Pune, Maharashtra have exclusive jurisdiction. Any dispute arising out of these Terms shall be resolved by arbitration seated at Pune under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed in accordance with that Act. The language of arbitration shall be English, and proceedings shall be kept confidential. Each party bears its own costs.
Severability. If any provision is held unenforceable, the remaining provisions continue in effect. Assignment. You may not assign your rights without our prior written consent; Bhowra may assign to an affiliate or successor. Notices. Notices to Bhowra should be sent to support@bhowra.com. Third-party rights. No third party may enforce these Terms.
